Terms and Conditions for Purchasing with No Worries Blinds 

The following Terms and Conditions, along with your official order and payment of order constitute a Contract of Sale between you, the customer, and No Worries Blinds .Changes to these Terms and Conditions may apply from time to time however are only undertaken and enforceable with the written permission of No Worries Blinds .

                                                     

1. Privacy Declaration

1.1  No Worries Blinds  are committed to respecting the privacy of its' customers. The following policy discusses how personal information received by No Worries Blinds  will be dealt with.

1.2  Although not required by law to comply with its' provisions, No Worries Blinds  by its' professionalism and commitment to its' customers operate within the boundaries of the Privacy Act 1988 (also sometimes referred to as the Privacy Principles Act or the Personal Information Privacy Principles Act) in dealing with its' customers.

1.3  In doing so, No Worries Blinds  customers will have the confidence that they are dealing with a supplier committed to excellence and security of its' customers private information.

Information Protection Principles

1.4  No Worries Blinds  must not do anything, or engage in any practice, that contravenes any information protection principles contained in the Privacy Act. In particular No Worries Blinds  declares that it will:

  1. Not collect personal information unless:
    1. the information is collected for a lawful purpose that is directly related to a function or activity of the purchase AND
    2. the collection of the information is reasonably necessary for that purpose
  2. Not collect personal information by any unlawful means
  3. Collect the information directly from the individual
  4. Make the individual to whom the information relates aware of:

  1. the purpose for which the information is being collected AND
  2. the intended recipients of the information AND
  3. whether the supply of the information by the individual is required by law or is voluntary, and any consequences for the individual if the information (or any part of it) is not provided AND

  5. the name and address of the Company that is collecting the information and the Company that is to hold the information.
  6. Ensure that any information collected is relevant to that purpose, is not excessive, and is accurate, up to date and complete, and that the collection of the information does not intrude on the personal affairs of the individual to whom the information relates
  7. Ensure that the information is kept for no longer than is necessary, that the information id disposed of securely, that the information is protected against loss, unauthorised access, use, modification or disclosure, and against all other misuse, and that if it is necessary for the information to be given to a person in connection with the provision of a service to the Company then everything reasonably within the power of the Company is done to prevent unauthorised use of disclosure of the information
  8. Help an individual to ascertain whether the Company holds personal information, whether the Company holds personal information relating to them, and, if so, the nature of that information, its purpose and their entitlement to gain access to the information
  9. Provide the individual with access to the information
  10. Make appropriate amendments (whether by way of corrections, deletions or additions) to ensure that the personal information is accurate, and relevant, up to date, complete and not misleading

10.Attach to the information, in such a manner as is capable of being read with the information, any statement provided by that individual of any amendment sought

11.Notify recipients of that information of the amendments made

12.Not use the information without ensuring that the information is relevant, accurate up to date, complete and not misleading

13.Not use the information for a purpose other than that for which it was collected unless;

 .      the individual to whom the information relates has consented to the use of the information for that other purpose OR

  1. the other purpose for which the information is used is directly related to the purpose for which the information was collected OR
  2. the use of the information for that other purpose is necessary to prevent or lessen a serious and imminent threat to the life or health of the individual to whom the information relates or of another person

14.Not disclose the personal information unless the disclosure is necessary to prevent or lessen a serious and imminent threat to the life or health of the individual concerned or another person.

15.Ensure that, if personal information is disclosed to a person or body that is a public sector agency, that the agency does not use or disclose the information for a purpose other than the purpose for which the information was given to it.

For the purposes of this declaration, personal information means information or an opinion (including information or an opinion forming part of a database and whether or not recorded in a material form) about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.

For the purpose of this declaration, Company means No Worries Blinds  Pty Ltd

 

2. Placing an Order

2.1  Orders can only be accepted by customers who have registered with No Worries Blinds  online and who have a registered customer email and password.

2.2  Placing an order with No Worries Blinds  is a simple as logging in, selecting your products, filling out the order form and paying for your order by one of the prescribed payment methods.

2.3  Once you have completed the order process, you will receive an email confirming your order details and payment details. You will be able to track your order at any point online by logging onto the No Worries Blinds  website and viewing your Order History online.

2.4  By placing an order and providing payment, you are agreeing to enter into a Contract of Sale. You are also agreeing to abide by the terms and condition as identified on the No Worries Blinds  website.

2.5  No Worries Blinds  reserve the right to refuse service, terminate an order, remove or edit website content at their discretion.

2.6  Your order stands confirmed ONLY when you receive notification from No Worries Blinds  confirming payment has been received.

 

3. Order Acceptance

3.1  Orders can only be accepted and paid for by persons over the legal age of 18 years. Persons under the age of 18 years are referred to as 'minors'. By placing an order with No Worries Blinds  you are acknowledging that you are not a minor and are over the age of 18 years.

3.2  No Worries Blinds  shall, in the event that an order is placed using a false declaration of a minor/s, have the right to recover any loss, financial or otherwise caused due to a transaction by a minor/s. The legal guardians or parents of the minor/s who place an order with No Worries Blinds  undertake the responsibility of any loss, financial or otherwise caused by such a transaction/s to No Worries Blinds .

 

4. Accepted forms of payment

4.1  No Worries Blinds  accept payment via; Visa Card, Master Card and Bank to Bank deposits Pay-Mate, Pay-Pall, Money Order, Company Cheque, Bank Cheque, Personal Cheque (Orders payed for by cheques will only be actioned on after the cheques are cleared and the funds are deposited in the  No Worries Blinds account ), Lay-Buy, Zip Money Interest Free (Conditions apply). No other forms of payment are accepted.

4.2  Payment processing will begin as soon as No Worries Blinds  have received all relevant order information.

4.3  The processing of payment for orders placed on a weekend or public holiday will commence on the next business day.

4.4  Credit card payment will only be accepted once you have confirmed you agree to the Terms and Conditions of sale, you acknowledge you are over 18 years of age and you are an authorised person to use the Credit Card for which details have been provided for the purpose of the order.

4.5  Upon clearance of all details, No Worries Blinds  will email you a tax invoice which is to be used for proof of purchase.

 

5. Product Delivery

5.1  No Worries Blinds  guarantee delivering your order within 5-7 working days for Ready Made blinds (as long as product is in stock at the time of order) and 15-21 working days for Custom Made blinds (please allow extra time for delivery if you are not located in Metro areas) .This period shall commence from the date of issue of your tax invoice indicating clearance of funds. The estimated time of delivery excludes weekends and public holidays.

5.2  Whilst every effort is made to work within these estimated delivery periods, sometimes this is out of the control of No Worries Blinds . In the event that you have not received your order in the timeframe indicated, you are required to contact No Worries Blinds.

You can track your order online under 'My Account'.

5.3  Orders will be delivered to the address provided for the order and as it appears on your Order Confirmation notification. In the event that your address cannot be found, you will be notified by email. In the event that there is no one there to collect your order, a calling card will be left with details of how to collect your order or arrange another delivery time. Should you agree to have your product left and not signed for, No Worries Blinds  shall not be held liable for goods delivered under these circumstances. You will be considered to be the owner of the goods after their delivery.

5.4  In the unlikely event that the order is returned to sender, the order will not be re-despatched until a new lot of postage has been paid by the customer to cover the cost of the resend. In this instance in all fairness, No Worries Blinds  reserve the right to hold onto the order until such times as the re-despatch postage payment has been paid by the customer. No Worries Blinds can not and will not be held responsible if the customer did not make the necessary arrangements in regards to receiving of goods on the day of delivery.

 

6. Changing or cancelling your order

6.1  For all products that are made to order, production normally begins the day after an order is placed. Therefore No Worries Blinds  are happy to change or cancel orders as long as No Worries Blinds  are contacted within one (1) business day (Monday to Friday) from the date the order was submitted to No Worries Blinds . Orders that are changed or cancelled after one (1) business day may incur additional charges.

6.2  Ready Made blinds not requiring resizing will generally be despatched on the next day of order. Orders cannot be changed once they have been despatched.

 

7. Freight Claim Policy

7.1  Upon receipt of your order, please be sure to inspect cartons/boxes carefully and note any immediately observed damaged to the driver.

  • Do not sign for badly damaged cartons or boxes
  • If you believe the cartons/boxes to be damaged but the product inside undamaged, ask the driver to give you a written copy of the order with a description of the damage
  • If product is damaged, do not discard the cartons/boxes. All freight claims must be reported to No Worries Blinds  using the issue form located in 'My Account' within two days of the original delivery date.

 

8. Returns Policy

8.1  Incorrectly filled or defective orders:

8.1.1  If you find that your No Worries Blinds  order has been incorrectly filled or is defective, please contact No Worries Blinds  immediately (within two working days of delivery receipt) using the approved issue form located in 'My Account'. Photo evidence will be required for verification. Important: If photo evidence is not submitted, the issue form becomes null and void.

8.1.2  No Worries Blinds  will endeavour to rectify the situation immediately upon verification of the particular case. Product deemed defective by a customer must be advised to No Worries Blinds  within two working days of receipt of delivery (copies of shipping/postage documentation will be required) using the appropriate issue form located in 'My Account' on the No Worries Blinds  website.

8.1.3  Upon verification of an incorrectly filled order, No Worries Blinds  will arrange for the immediate shipment/return of required items at no cost to the customer.

 

8.2  Incorrect Blind Measurements provided by Customer:

8.2.1  Ready Made blinds bought from stock may be exchanged if they are returned within 7 days of purchase in the original, unopened and undamaged packaging, in like-new resalable condition and accompanied by your receipt. Delivery charges and 30% restocking fee will apply. Customers are required to advise and restocking of their required exchange using the issue form located in 'My Account' on the No Worries Blinds  website.

8.2.3  Items that have been customised or resized cannot be returned. Custom Made blinds are made to fit your window after you place an order. Each blind is manufactured to your unique measurements and specifications. For this reason we are only able to accept returns on orders that are incorrectly filled by No Worries Blinds  or are defective.

 

8.3  Customer alters product after receiving delivery or misuses the product:

8.3.1  In the event that a customer chooses to alter product or have the product altered by another provider and the product is damaged and/or does not fit as a result of the alteration, or in the event that the customer misuses the product for purposes other than the intent of being a window furnishing, No Worries Blinds  shall not be held responsible for the alteration or damages and shall not refund or replace the altered product.

8.3.2  No Worries Blinds  reserves the right to charge on a time and materials basis in respect of any repairs, replacement, collection and return of the product which No Worries Blinds  agree to carry out at the customer's request.

8.3.3  No Worries Blinds  will be entitled to debit your credit card used for the original purchase for the amount notified to you for the collection, repair/replacement and return freighting of goods prior to any action being taken, and only if the charges have been agreed to by the customer.

8.3.4  All defective orders (be they incorrect measurements or damaged goods) MUST be reported to No Worries Blinds  within two working days of delivery for No Worries Blinds  to work with the customer on rectifying the situation. If No Worries Blinds  has not been advised of damaged or non-fitting products in line with No Worries Blinds  Returns policy then they are not in a position to assist the customer nor can they be held accountable.

 

8.4  Incorrect colour choice:

8.4.1  The product information and photographs contained within the No Worries Blinds  website are provided for illustrative purposes only. If you have any doubt as to the precise colour of the product you wish to order, you are strongly advised to order a colour sample prior to making a final product purchase ( and this samples are FREE). No Worries Blinds  shall not be held responsible for colour choices made on the basis of web images (see section Colour display).

8.4.2  Returns received by No Worries Blinds  from customers who have not completed the user-friendly issue form located in 'My Account' will experience delays until such time as the issue form has been received and No Worries Blinds  endeavours to obtain the relevant information.

 

9. Errors in your order

9.1  It is very important that you follow No Worries Blinds  measuring and installation instructions. When you follow No Worries Blinds  instructions we guarantee your blinds will fit perfectly! It is equally important that you review your email order confirmation for accuracy. Of course No Worries Blinds  realise that mistakes may occur and if No Worries Blinds  make a mistake on your order No Worries Blinds  will either repair or remake it at no charge to you. If you make a mistake in measuring or ordering please contact No Worries Blinds  as soon as possible. Depending on the type of error it may be possible to return the product to the factory for exchange for Ready Made Blinds (only) provided they are in their original and unopened condition. The option shall be at the discretion of No Worries Blinds  based on the type of claim a 30% restocking fee may apply. The customer shall be responsible for the cost of freight and arranging of the return freight. Resized (cut to size) Blinds and Custom Made blinds cannot be returned to the warehouse for replacement or exchange.

 

10. Refunds

10.1  In the event that a refund is required, after investigation of a return by No Worries Blinds , any refund will be issued through the same payment medium in which your original purchase was made to No Worries Blinds .

10.2  Authorisation for any refund cannot occur until such times as the product has been returned to and received by No Worries Blinds  along with a completed issue form located in 'My Account'.

10.3  No refunds are permitted in the event that the customer is simply unhappy with their purchase or has changed their mind.

 

11. GST

11.1  Goods and Services Tax (GST) is a federal tax introduced by the Australian Government. Unless otherwise mentioned on a quote, product listing or any other documentation issued by No Worries Blinds , all prices quoted are inclusive of GST.

 

12. Prices

12.1  All prices listed on the No Worries Blinds  website, in quotes, invoices or any other documentation issued by No Worries Blinds  are in Australian dollars unless otherwise stated.

 

13. Credit Card Fraud

13.1  No Worries Blinds  have incorporated what they believe to be the safest online payment medium for their customers. Despite these best efforts, in the event that sensitive Credit Card information of a customer has been compromised, No Worries Blinds  shall not be held responsible for any damages, consequential losses, direct or indirectly suffered by the customer. Such events can include but are not limited to computer hacking of personal computers, internet redirection of keystrokes or other incidents that are beyond the control of No Worries Blinds  or the use of an individual's credit card by an unauthorised person.

15. Colour Display

15.1  No Worries Blinds  engage the services of professional photographers, web design specialists and product manufacturers to ensure the best display of all products, colouring, accessories and instructions as accurately as possible. The accuracy in colour of all products displayed online is subject to the colour settings on your individual monitor. As such No Worries Blinds  cannot guarantee that your monitors display will give you a true representation of product colours. So please make sure that you order the FREE fabric samples

to make sure you are ordering the colours you need.

 

16. Product Samples

16.1  No Worries Blinds  make every reasonable effort to ensure the colours shown on the No Worries Blinds  website accurately match the products sold by No Worries Blinds . However, there may be some differences in actual colour due to differences in computer systems and colour monitors. Some textures may not be clearly visible. Natural products like wood and bamboo have a natural character and may have subtle colour differences. For the most likely accurate colour match, No Worries Blinds  request that you order samples.

16.2  In addition, it is recommended that you order ALL your blinds of a given colour at the same time as there can be minor variations between dye lots.

 

17. Product Warranties

17.1  In addition to the manufacturer's warranty, No Worries Blinds  provide a 24 month (two year) warranty on products listed on the No Worries Blinds  website from the date of original purchase unless otherwise stated.

17.2  No Worries Blinds  warranty excludes product fading, malicious damage, misuse, product that has been removed from the original delivery address, product that has been altered or tampered with in any way from its original delivered condition.

17.3  Return of product under warranty must be arranged by the customer. All costs associated with the return of the product must in the first instance be borne by the customer until such times as No Worries Blinds  can assess the case. If deemed a reasonable warranty claim, No Worries Blinds  will replace or repair the product and return by courier to the original customer.

17.4  If a product is replaced or repaired within its two year time frame the warranty is not extended. The warranty period begins from the date the order was placed and concludes two years post this date. (I.e. A product does not receive an additional two years warranty from the time it is replaced. If there is X months left on the warranty period, the new item/ replaced part will be covered for this time frame only.)

17.5  For manufacturer warranties and in some instances manufacturer's extended warranties, please refer to individual product pages.

 

18. Discontinued Products

18.1  From time to time a product or fabric may be discontinued to make way for a new product or in the event the mill no longer produces the colour or pattern. No Worries Blinds  make every effort to keep products up to date on their website however, in the case that a product becomes discontinued; this is beyond the control of No Worries Blinds . Should an order be placed for a product that is discontinued, a No Worries Blinds  Customer Service representative will contact you immediately and an alternative product may be selected or a refund for that particular product ordered given.

 

19. Back Orders

19.1  In the event that an order from a supplier is delayed, or in the event that No Worries Blinds  may be experiencing a busier than usual period, or in the rare event that a product is placed on back order, No Worries Blinds  will notify the customer within 48 hours with a new estimated time of delivery.

 

20. Exclusion of Liability

20.1  No Worries Blinds  shall not be liable for any loss of income, profits, contracts, data or for any indirect or consequential loss or damage of any kind whatsoever arising, and whether caused by tort (including negligence), breach of contract or otherwise resulting from purchases made through No Worries Blinds 

20.2  In the event of a refund, the maximum amount for which No Worries Blinds  undertakes liability shall under no circumstances exceed the amount paid by the customer for the product including postage and handling.

20.3  No Worries Blinds  shall not accept liability for:

  • incorrect measurement by the customer for any purchases
  • incidental and or inconsequential damages as a result of purchases
  • the cost of installation, removal or reinstallation of any product

 

21. Corrections and Continuous Improvement

21.1  No Worries Blinds  pride themselves on being leaders in not only product but also on their levels of customer service. This includes the information provided to customers on product selections and purchases. Whilst endeavouring to provide accurate and up to date information, We Are All Human after all and in a rare instances, where typographical errors and inaccuracies may occur. No Worries Blinds  reserve the right to correct any errors, inaccuracies or omissions and to change or update information or pictures at any time without prior notice (including after you have placed your order). Possible changes may include but are not limited to product type, price, photographic depiction and availability.

 

22. Contracts of Sale

22.1  All Contracts of Sale entered into are between the customer and No Worries Blinds . No rights and or obligations whether in part or in whole can be assigned to a third party without the express written permission of No Worries Blinds . Any third party transfer without the written permission of No Worries Blinds  shall be deemed to be null and void.

22.2  In the event that a competent authority holds part of the Terms and Conditions as laid down on this website or those deemed to form part of the Contract of Sale to be invalid or unenforceable in whole or part, the validity of the remaining Terms and Conditions shall not be affected.

22.3  Under the Trades Practices Act 1974 ("ACT") where implied conditions and warranties cannot be excluded, any liability on No Worries Blinds  for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited at the option of No Worries Blinds  to the replacement of the product/s or the re-supply of the same product/s; the payment of cost of replacing the product/s or of providing equivalent product/s. Governing disputes are covered under the state law of business registration which in the case of No Worries Blinds  is the state of Queensland in the Commonwealth of Australia.

 

23. Terms and Use of the No Worries Blinds  Website

23.1  The Australian owned website of No Worries Blinds  or any portion of the No Worries Blinds  website may not be reproduced, duplicated, copied, sold, resold, plagiarised or otherwise exploited for any commercial purposes that is not expressly permitted by No Worries Blinds , PLoza Family Trust Pty Ltd or NoWorriesBlinds.com.au

23.2  No Worries Blinds  reserve the right to refuse service and/or cancel orders at its discretion including, without limitation, if Blinds Warehouse believes that customer conduct violates applicable law or is harmful to the interests of No Worries Blinds .

Part of the success of No Worries Blinds  over the years has been our low upfront price policy. We offer most items at already discounted prices. Our Sales Team are trained to recognise this policy and will, if asked, advise customers of their inability to grant the request for a discount.

At No Worries Blinds  we stand behind our products and are passionate about bringing the very best to customers in regards to quality, price, choice and service.

  • As a part of the PPC Pay per Click advertising management program, No Worries Blinds  IT department monitor the click through actions from respective visitors. Click Fraud is easily identified using the TOPD.CCL version2.
  • If a visitor is deemed fraudulent by their click through actions to one of the No Worries Blinds  PPC programs their details are recorded.
  • Using the TOPD.CCL we can identify the visitor details, visitor's website and visitor contact details. The details will be used to take action against the fraudulent visitor and in most cases if the visitor is a part of any PPC program the click through will be reciprocated using the tracking system TOPD.CCL automated response settings.
  • The team at No Worries Blinds  have been in the industry for many years and appreciates that when placing an order, customers can inadvertently enter incorrect information and/or choices.
  • It is imperative you follow the instructions contained in the measuring guide and provide No Worries Blinds  with exact window measurements. If you follow the Measuring Guide and do this, then we can guarantee you a perfect fit.
  • NEVER work off house plans, measurements of existing blinds or any other formula you may have heard about as we cannot guarantee the fit of your blinds if you do and we will not be held accountable.
  • It is equally important that you review your order for accuracy prior to payment.


    • What to do if you discover an error after you have placed or received your order
    • Should you identify an error in your order, you are asked to contact No Worries Blinds  immediately by completing a Issue Form.
    • In the unlikely (but possible) event that we make a mistake in the processing or despatching of your order, we will either repair or remake it at no charge to you.
    • You are asked to notify No Worries Blinds  by logging into your personal account and submitting your Issue Form immediately when you identify an error in your order. One of our Customer Support Team members will contact you within one business day after receiving your form.

We are proud of the efficient turn around service for customer orders. Most orders (with the exception of those requiring clarification) are sent to the warehouse for processing within one business day of being received into our system.

We understand that customers can and do change their minds regarding an order after it has been placed. In the event that you do need to change any part of your order, provided you notify No Worries Blinds  within one business day of placing the order we can generally change or cancel your order as per your request.

Customers requesting orders to be changed or cancelled after one business day may be declined their request or incur additional charges depending on whether their order contains Custom Made or Ready Made blinds and how far into the production process their order is at the time of the request.

Ready Made Blinds not requiring resizing are generally processed and despatched the same or next business day depending on the time of day they are ordered.

Ready Made Resized (Cut to size) Blinds and Custom Made Blinds are generally processed the next business day after being ordered.

Please note:

  • Orders cannot be changed or cancelled once they have been despatched
  • The term 'Business Day' refers to - Monday, Tuesday, Wednesday, Thursday and Friday (excluding public holidays)

No Worries Blinds  entrust your orders to reputable courier companies. Whilst every care is taken in our warehouses to pack your goods carefully and address them correctly, No Worries Blinds  cannot be accountable for the daily operations of each individual courier company.

It is the responsibility of each customer to carefully inspect their order upon delivery by the courier company.

 

Goods damaged during shipping

In the event that you have inspected your order upon delivery and have observed the packaging to be damaged in any way:

  • Advise the courier driver immediately that you have observed damaged cartons or boxes and request that the damage be recorded on their delivery manuscript against your order and ask the driver to give you a written copy of the report.
  • You do not sign for badly damaged cartons or boxes
  • Do not accept badly damaged cartons or boxes - request they be returned to sender
  • If possible take photos of the damaged cartons that you are returning to sender
  • Notify No Worries Blinds  immediately that you have requested the goods to be returned to us as they were damaged in shipment. You can notify No Worries Blinds  through your personal account area by completing the relevant Issue Form and can attach any photos of the damaged cartons if available
  • If you believe the cartons to be damaged but the products inside may be still ok, ask the driver to give you a written copy of the order with a description of the damage.
  • If items are damaged, do not discard boxes and packaging. All shipping claims must be reported to No Worries Blinds  through your personal account area by submitting the relevant Issue Form within two days of the original delivery date.

Remember: No Worries Blinds  will not be responsible for goods that you have authorised to be left and unsigned for upon delivery in the event you are not home to accept delivery of the goods.

In the event that by following the above procedures No Worries Blinds  can validate that your order has been damaged during shipping and the goods have been returned to our warehouse, No Worries Blinds  will arrange for the immediate re-processing of your order and re-despatchment at no cost to you, the customer, upon receipt of your completed Issue Form.
